Please read these terms carefully before using Genso AI. By using our service, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using Genso AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any modifications.
2. Account Registration
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information up to date. You must be at least 13 years of age to use this Service (or the minimum age required in your jurisdiction).
3. Credits & Payments
The Service operates on a credit-based system. Credits are purchased through subscription plans or one-time top-ups. All purchases are final and non-refundable unless required by applicable law. By completing a purchase, you consent to immediate access to the digital service and acknowledge that you waive your 14-day right of withdrawal under the EU Consumer Rights Directive once credits are used. Subscription credits reset at each billing cycle and do not roll over. One-time credit purchases do not expire. Prices are subject to change with reasonable notice.
4. Acceptable Use & Prohibited Content
You agree not to use the Service to generate content that: (a) violates any applicable law or regulation; (b) infringes on the intellectual property rights of others; (c) depicts, sexualizes, or exploits minors in any way — the generation of child sexual abuse material (CSAM), child exploitation imagery, or any sexualized content involving minors is strictly prohibited and will result in immediate account termination and reporting to the relevant authorities (including NCMEC); (d) constitutes non-consensual intimate imagery or deepfake pornography of real individuals; (e) constitutes harassment, threats, or hate speech directed at real individuals; (f) is used for deception, fraud, or impersonation for malicious purposes; (g) generates realistic images of identifiable real persons without their consent; (h) promotes terrorism, extreme violence, or self-harm. We employ automated content moderation systems to detect and block prohibited content. We reserve the right to terminate accounts that violate these policies without refund and to cooperate with law enforcement where required.
5. Generated Content & Ownership
Content generated through the Service is owned by you, subject to the underlying model licenses and these Terms. You bear full legal responsibility and liability for all content you generate, distribute, publish, or otherwise make available using the Service. You are responsible for ensuring that your generated content complies with all applicable laws and regulations in your jurisdiction, including but not limited to intellectual property, privacy, defamation, and obscenity laws. You grant Genso AI a non-exclusive, worldwide license to use generated content for service improvement, marketing, and promotional purposes unless you opt out. Genso AI acts solely as a technology provider and is not liable for any consequences, claims, damages, or legal actions arising from your use, distribution, or publication of generated content.
6. Creator Program
Participation in the Creator Program ("Invite & Earn") is subject to additional terms. Views are verified through our automated watermark detection system. Genso AI reserves the right to adjust earning rates, disqualify fraudulent views, and terminate program membership for policy violations. Earnings are calculated monthly and paid within 15 business days of the calculation date.
7. AI Models & Third-Party Services
The Service utilizes various AI models and third-party APIs to power its generation features. Certain generation capabilities are powered by third-party AI models that may be presented under Genso AI product names (e.g., "Genso Animate", "Genso Imagine", "Genso-Image-Pro", "Genso-Motion-Adapter"). These product names are internal branding used for ease of reference and do not represent claims of proprietary model development. The underlying models remain the intellectual property of their respective creators and are used in accordance with their licensing terms. We do not guarantee the availability, accuracy, or quality of any specific model. Models may be updated, replaced, or removed at any time. Generation results may vary and are not guaranteed to match expectations. We are not responsible for the output of third-party AI models.
8. Privacy & Data
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy. Uploaded images and generated content may be processed by third-party AI providers subject to their respective privacy policies.
9. Limitation of Liability
The Service is provided "as is" without warranties of any kind. Genso AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you have paid to Genso AI in the twelve months preceding the claim.
10. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Any unused credits will be forfeited upon termination for cause. You may terminate your account at any time through your account settings.
11. DMCA & Copyright
Genso AI respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please visit our DMCA Policy page at gensoai.io/dmca for instructions on filing a takedown notice. We may terminate accounts of repeat infringers.
12. AI-Generated Content
All content generated through the Service is produced by artificial intelligence and is marked with machine-readable metadata identifying it as AI-generated. You are responsible for disclosing the AI-generated nature of content where required by applicable law. Genso AI does not guarantee that AI-generated content is free from resemblance to real persons, copyrighted works, or trademarks.
